<br />Subd.4 Variances. . <br />A. Public Hearing. A public hearing is not required but neighboring property <br /> owners shall be notified. <br />B. Action to Approve. A majority vote of the Council is required for action to <br /> grant a variance. <br />"____._.. _____._ n_____.__._____ .._---- .-- <br />C. Intent and Purpose Variances from the literal provisions of the Zoning Code <br /> may be granted in instances where the strict enforcement would cause undue <br /> hardship because of circumstances unique to the individual property under <br /> consideration. Variances shall only be granted when it is demonstrated that <br /> such actions will be in keeping with the spirit and intent of the Code. <br /> "Undue hardship," as used in connection with the granting of a variance, <br /> means the property in question cannot be put to a reasonable use under <br /> conditions permitted by the Zoning Code, the plight of the landowner is due <br /> to circumstances unique to the property not created by the landowner, and <br /> the variance, if granted, will not alter the essential character of the locality. <br /> Economic considerations alone shall not constitute an undue hardship if <br />_---.!:~ason~_ble_use!~?~ the ProP~E!y exists under t~~ terms of the Code=-_ <br />D. Variance Restrictions. In no case shall the !"Yfanting of a variance impair the <br /> health, safety, comfort and general welfare of the public, nor will it be . <br /> contrary to the intent and purpose of the Comprehensive Plan, the official <br /> map, or this or any other ordinance of the City. Variances to allow a use that <br /> is not pennitted in the district shall not be granted. <br />E. Allowable Variances. Variances normally relate to the dimensional <br /> provisions of the ordinances such as, but not limited to, building setback <br /> lines, lot area requirements and the like but may also relate to other <br /> requirements, regulations or procedures. <br />F. Conditions to Insure Compliance. The Council may impose conditions in <br /> the granting of variances to insure compliance and to protect adjacent <br /> properties as well as the health, safety, comfort, and general welfare of the <br /> public. <br />G. Height Variances. Variance to height of structure may be granted in <br /> accordance with Chapter 1325.03 Subd 3. <br />Subd. 5 Site Plan Review. <br />A. Public Hearing.
