Most cities have switchcd to calling these types of uses and pemlits "conditional <br /> usc" and "conditional usc pcrmits;' which is the language used in State Statutes. Tcchnically, a <br /> city is required to approve a conditional/special use permit if the applicant can successfully <br /> demonstrate that the potential ncgative impacts of the proposed use can be mitigated. Howcver, <br /> a city is allowed to apply conditions to a conditional use to ensure that the negative impacts of a <br /> conditional use arc mitigated. <br /> FUl1hermore, "specialllse" implies that it is a use that is not normally pcrmitted but can be <br /> specially grantcd if the City so chooses. Thc conditional use language more accurately describes <br /> the process and is a better reflcction of State Statutes. Please notc that changing the title of the <br /> pcnnit or process will not impact thc City's review process or past spccial usc permits.
