<br />Recommendation <br />The proposed lots still conform to the subdivision regulations, no variances are required to meet . <br />thc City"s rcgulations. and no changes have been made to the subdivision or zoning regulations <br />that would impact the proposcd plat; thcrefore, Staff recommends approving the rcquest for an <br />extension to submit the final plat application by December 31, 2006. <br />Staff s recommcndation is su~ject to thc original sevcnteen conditions plus one additional <br />condition rclatcd to tree protcction: <br />1. The prcliminary plat shall be contingcnt upon approval of a rcquest to vacate a portion of <br /> the utility casement for the driveway on proposed Lot 3. <br />2. The applicant shall comply with applicable provisions of the City Code and relatcd <br /> ordinances. <br />3. Thc applicant shall submit thc final plat and application to the City of Arden Hills within <br /> threc months of the preliminary plat approval date or the approval shall expire unless an <br /> extension is granted by the Planning Commission. The final plat shall reflect all changes <br /> required in the conditions of approval for the preliminary plat. <br />4. The project shall be completed in accordance with the plans submitted as part of the <br /> prcliminary plat application. Any significant changes to these plans, as determincd by <br /> the City Planner, shall requirc review and approval by the Plmming Commission. <br />5. The applicant shall include a 12 foot drainage and utility easemcnt centercd on all <br /> common lot lines, and a 12 foot drainagc and utility eascment along the right-of-way. <br />6. Thc applicant shall pay a park dedication fee as dctcnnined by the City Council at the <br /> time the final plat is approved. . <br />7. The applicant shall amend the final plat to be in confomlance with all of the comments <br /> from the July 3rt!, 2006, memo from the City Enginccr. <br />8. Any extension of City services for the ncw lot shall be subject to review and approval by <br /> the City Engineer and all associated costs shall be the responsibility of the applicant. <br />9. Erosion control measures shall be installed before any grading or construction begins and <br /> shall be maintained and remain in place until groundcover is reestablishcd and <br /> construction is finished. <br />10. All non-conforming structures shall be removed as indicatcd on the site plan bcfore the <br /> final plat is filcd and before any building permits are issued. I f, however. thi s is not <br /> possible, the developcr shall post a financial surcty with the City to ensure removal <br /> within one year from thc approval o[the final plat. <br />11. The applicant shall submit an approved road access pennit from Ramsey County bctore <br /> the final plat is approved. <br />12. Any changcs to the grading or erosion control plan shall be subjcct to approval by the <br /> City Enginecr. <br />13. The applicant shall obtain all necessary pcnnits from the Rice Creek Watcrshed District, <br /> Ramsey County, the Statc of Minnesota Departmcnt of Natural Resources and any other <br /> goveming agencies where applicable before the final plat is approved. <br />14. The applicant shall provide an as-built survey upon completion of the project. <br />15.
