Lehnhoff stated applicant was requesting construction of a 2,250 square foot addition <br /> to thc west side of Building N. Staff recommended approval of the Planned Unit <br /> Developmcnt Mastcr Plan (sth) Amendmcnt and Site Plan Rcview based on the submitted <br /> plans and findings subjcct to thc following conditions: <br /> 1. Thc applicant shall continue to abide by the conditions of approval as statcd in the <br /> approved !\1aster Plan PLJD except as amend cd by thc seven subsequcnt <br /> amcndmcnts. <br /> 2. A pun Amcndmcnt form, drafted by the City Attomey, shall amend the PUD and <br /> encompass all scven amendmcnts to the Master Plan pun. A building permit <br /> may only be issued after thc pun Amcndmcnt document rcceives thc approval of <br /> the City Council and is executed by both the City Council and thc applicant. <br /> .., The project shall bc completed in accordance with the plans submittcd as part of <br /> -). <br /> thc master plan amendment and site plan review application. Any significant <br /> changes to thesc plans, as determined by the City Planner, shall rcquirc review <br /> and approval by the Planning Commission. <br /> 4. The master plan amcndment and sitc plan rcvicw shall automatically expire and <br />. become void one (I) year li'om and after the date on which thc Council grantcd <br /> such approval if work on the project has not begun within that timc period. <br /> 5. The applicant shall obtain any nccessary permits from the Rice Crcek Watcrshed <br /> District, the Minnesota Pollution Control Agcncy, and any other neccssary <br /> permits beforc a building permit is issucd. Thc City shall he copied with all <br /> required pe11nits. <br /> 6. Any changcs to thc grading, erosion. or drainage plans shall be submitted to the <br /> City Enginecr for approval. <br /> 7. Thc applicant shall comply with the conditions recommended by thc City <br /> Enginecr in the October 23, 2006, memo to the City Planncr. Updated site plans <br /> shall bc submitted for approval by the City Engineer beforc any building permits <br /> arc issued. <br /> S. If noise Ii-om the building exceeds MPCA noise regulations for residential arcas at <br /> the property line, the applicant shall reducc noisc by any means necessary to be in <br /> compliancc \vith l'v1PCA regulations. If any complaints regarding noisc are made <br /> to thc City, thc applicant shall be responsiblc for providing decibel mcasurements <br /> from the property line and reducing noise levels to be in compliance \vith MPCA <br /> rcgulations. <br /> 9. A traffic study shall be conductcd and submittcd to the City for revie\v to <br /> dctcnnine if road improvcments are nceded prior to thc submission of any <br /> application(s) that would causc the total new square footagc to excced 419,500 <br /> square fcet sincc the Master Plan was approved in 2002. <br /> 10.
