Recommendation The Planning Commission reviewed Planning Case 06-028 and unanimously (5-0) recommends approval ot'thc Sitc Plan Review for re-Iandscaping 3433 Lake Johanna blvd based on the suhmitted plans and a finding that the rc-Iandscaping plan will work to resolve the clear-cutting violation and will work to addrcss screening, erosion, and stomlwater concerns, The follO\ving ten conditions were included with the recommendation: ] The landscaping plan shall be completed in accordance with the plans submitted within one year from the date of approval. Any significant changcs to these plans, as determined by the City Planner, shall require rcview and approval by the Planning Commission. 2. The applicant shall obtain and submit a copy to the City of all necessary pcrmits (rom the Rice Crcek Watershed District before a building permit is issued, , The applicant shall submit a financial surety in the amount of 125 pcrcent of the ,) . estimated cost of the landscaping prior to beginning the landscaping and prior to receiving any building permits. The surety shall include the lalldscaping for the entire . property, including the shoreline landscaping, The financial surety shall bc subject to approval by the City Attorncy and the folIO\ving release schcdule: a. 50(}~ of the total financial surety shall be released upon full implementation of the landscaping plan that is approved by thc City and after a successful inspection by City Staff. b. 30% of the totallinancial surety shall be released after the first full ycar after implementation and a successful inspection by City Staff c. 2()l% of the total financial surety shall bc released aller the second full year and a successful inspection by City Stall. 4. lJpon completion of the landscaping and prior to releasing any portion of the financial surety, the City Planner shall inspect the landscaping to ensure that it is in compliancc with the approved plans, .5. Any vcgetation within the landscaping plan that are deemed dead or dying by the City Planner or City Forester shall be replaced within three months or, if not possible due to the end of the growing season, by the beginning of the next planting season.
