PLANNING CASE 06-028: SITE PLAN REVIE\V, HIEN NGO AND NGUYET <br /> KY, 3433 LAKE JOHANNA BOULEVARD <br /> Mr. Lehnhoff stated thc applicant was requesting approval of the modified landscaping <br /> plan [or 3433 Lake Johanna Boulevard, Staff recommendcd approval of the landscaping <br /> plan subjcct to the following conditions: <br /> 1. The landscaping plan shall be completed in accordance with thc plans submitted <br /> within one year from thc date of approval. Any signilicant changes to these <br /> plans, as detcrmined by the City Planner, shall rcquire rcview and approval by the <br /> Planning Commission. <br /> 2. The applicant shall obtain and submit a copy to the City of all necessary pennits <br /> from the Rice Crcek Watcrshed District hefore a bui Iding pcnnit is issued, <br /> 3. The applicant shall submit a financial surety in the amount of 125 percent of the <br /> estimated cost of the landscaping prior to beginning the landscaping and prior to <br /> receiving any building permits. The surety shall include the landscaping for the <br /> entire property, including the shorelinc landscaping. The financial surety shall be <br /> subject to approval by the City Attorney and a release schedule determined by the <br /> City. <br /> 4. Upon completion of the landscaping and prior to releasillg any portion of the <br /> financial surety, the City Planner shall inspect the landscaping to ensure that it is <br /> in compliance with the approved plans. <br />. 5, Any vegetation within the landscaping plan that are dcemcd dead or dying by the <br /> City Planncr or City Forcster shall be replaced within three months or, if not <br /> possible due to the end of the growing season, by the beginning of the next <br /> planting season. Any trecs, shmbs, or bushes that nced to be replaccd shall be <br /> done so with the same species. Using a different species shall require approval <br /> from the City. <br /> 6. Best managemcnt practices shall be used to maintain erosion control until <br /> construction and landscaping are completed, Changes to the erosion control <br /> measurcs shall be subject to approval by the City Engineer. <br /> 7, The landscaping plan shall be modificd as follows: <br /> a. The black hills spruce trces shall bc at least ten feet tall upon planting. <br /> b, The sienna glen maple trcc shall be at least three caliper inches upon <br /> planting. <br /> c, Thc velvct pillar crabapplc trees shall be at least 2.5 caliper inches upon <br /> planting. <br /> d, Any mulch or othcr similar matcrials used to cover the ground shall be <br /> ncutral in color. <br /> e, Thc autumn brilliance c1umpberries shall be at least seven feet tall upon <br /> planting. <br /> f. The compact amur maples shall be at least four fcet upon planting. <br /> 8, No additional trces shall be removed from the public rights-of-\vay without <br /> permission from the City Forester and City Planner. <br />. <br /> DRAFT <br />
