<br /> 5. The messages shall not flash, scroll, or use animated pictures or . <br /> animated logos. <br /> 6. The text on the message center shall be monochrome in <br /> appearance. <br /> 7. The brightness of the message center shall be modified for <br /> daylight and nighttime operational hours so as not to distract <br /> automobile traffic. The City may require the applicant to adjust <br /> the brightness of the sign if the City determines that the sign is <br /> distracting drivers. <br /> 8. The 1310 County Road E property shall not be permitted to have <br /> any permanent freestanding signs as long as the property has a <br /> freestanding sign on the 1306 County Road E property. <br /> 9. The applicant shall agree to change the forms of message entry, <br /> the forms of message exit, message center brightness, the <br /> frequency of message changes, and other aspects of the <br /> electronic message board if the City determines that the sign is or <br /> could be distracting drivers. <br /> 10. The applicant shall comply with future City regulations that <br /> regulate the brightness, message frequency, message entry, <br /> message exit, animation, and other applicable regulations of <br /> electronic message board signs. The operation of the electronic <br /> message board in this application shall not be grandfathered in <br /> with future regulatory changes regarding electronic message . <br /> board signs. <br />4.0 ENFORCEMENT. The City shall notify Applicant of any violations of the terms <br /> of this Agreement. Upon receipt of a violation notice, the Applicant shall have <br /> seven (7) days to correct the violation or, upon failure to do so, the electronic <br /> message center shall be shut down one day for each offense. Each violation of <br /> the conditions of operation shall be considered a separate offence and shut <br /> down days can accumulate. This provision shall not restrict or remove the <br /> City's right to pursue other legal options for enforcing the conditions of this <br /> agreement and other City regulations. Applicant shall reimburse the City for <br /> all costs which it incurs, including legal fees, in order to enforce the terms of <br /> this Agreement and City regulations. <br /> . <br /> 2 <br />
