<br /> 10470 <br />. 050003 <br /> 01 <br /> AGREEMENT TO CONVEY EASEMENT <br /> RIGHT OF ENTRY <br /> C' <br /> 1.0 PARTIES. This Agreement is dated thJJ\day of ~~f_. 2006 and is <br /> entered into by and between the City of Arden Hills,' a Minnesota statutory city <br /> ("City") and Arlene P. Boutin, a single person ("Grantor"). <br /> 2.0 RECITALS. <br /> A. Grantor is the fee owner of the following described real property <br /> situated in the City of Arden Hills, Ramsey County, Minnesota (the <br /> "Property") which is as follows: <br /> lot 1, Lot 2 and Lot 3, Block 2, Arden HHls and Lot 1, Block 1, <br /> Week's Addition, according to the plats thereof on file and of <br /> record in the Office of the County Recorder, Ramsey County, <br /> Minnesota <br /> B. The City has let contracts and is in the process of constructing the 2006 <br /> Pavement Management Project (the "Improvement Project'). <br />. C. The City wishes to acquire certain permanent storm water drainage and <br /> utility easements over, under and across portions of the Property and <br /> certain temporary construction easements over portions of the Property <br /> in order to construct the Irnprovernent Project. <br /> D. Grantor has agreed to convey such easements subject to the terms of <br /> this Agreement. <br /> 3.0 TERMS AND CONDITIONS. In consideration of the mutual undertakings herein <br /> expressed, the parties agree as follows: <br /> A. (, r_~ lJ t9L'~_ 9l2!-.ig Clt i.Qn _s. <br /> 1. Obtain, at its sole cost, the necessary permits from the DNR, the <br /> Rice Creek Watershed District and the City prior to the placement <br /> of any fill on the Property. <br /> 2. Convey permanent easements in substantially the form shown on <br /> Exhibit A attached and further illustrated on Exhibit B attached <br /> upon completion of the City's review of title to the Property. <br />. <br />
