Mr. Filla stated he envisioned this the same way and ifhe was needed he would be available, but <br /> staff would coordinatc the attorneys, <br /> MOTION: Councilmembcr Larson moved and Mayor Aplikowski seconded a motion <br /> to authorize staff to enter into an agreement for services with Stephen]. <br /> Bubul of Kennedy & Graven Chartered based on the lctter datcd September <br /> 8, 2006 from Mr. Bubul, not to exceed $50,000 with the intention of <br /> recovering all costs in the interim and master agreements. <br /> Ms. \V olfe stated staff understood Council's expectations and they would do their bcst to carry <br /> thcm out. Councilmember Holden stated they had decided awhile ago not to spend current <br /> resident's money, but they had been spending resident's money and they needed to be cautious <br /> about this. <br /> Councilmember Larson stated he did not remember them having a motion on this and he <br /> believed all residents shared in City costs. He indicated they did not want to divide the City by <br /> residents who lived north of Highway 96 and south of Highway 96. <br /> Councilmember Holden stated she did not agree with Councilmember Larson and she recalled <br /> the discussion differently, <br />. Mayor Aplikowski stated it was not realistic to think that the City would not spend money on <br /> TCAAP, but the City would be careful with any funds spent. She stated the City was recouping <br /> everything they could from the development team, but there would be some things the City <br /> would end up paying for. <br /> The motion carried unanimously (4-0). <br /> 8. UNFINISHED BUSINESS <br /> A. TCAAP <br /> Ms. Barton updated on the Council on recent TCAAP developments. <br /> 9. COUNCIL COMMENTS AND REQUESTS <br /> A. Councilmember Grant stated the Property Task Maintenance Force had completed <br /> its work and would be forwarding its recommendation to Council in the future. <br /> MOTION: Councilmember Grant moved and Councilmember Holdcn seconded a <br /> motion to adjourn to a closed session to discuss the Rochon Corporate <br />. Arbitration/Mediation case, pursuant to MS 130.05 Subd 3,b. <br />
