This program includes inspecting elm and oak trees for diseasc disruption, root grafts, and the removal of and proper disposal of diseased trees and wood. It is the responsibility of the home owner to remove the diseased or dying tree(s) from their property with in ten (10) days of the notice date. . According to thc City Trce Inspector, an incident of Dutch Elm Disease or Oak Wilt Disease was found on your property. A diseased trce notice, dated Julv 25. 2006 was sent as certified, rctum receipt mail to you infonning you ofthe diseased trec(s) and the action(s) required to resolve this situation. As of today, it has been.Jl days since the notification date. Section 710.12. Subdi vision 12 states that "in Ihe cvent the owner fails or refuses to abate the nuisanccs as so required, then the forestcr shall upon orders from the Council, abate the nuisance by cutting down diseased shade trces and removing all pm1s, branches and brush thereof: together with any diseased wood of any diseased shade trees located on the premises, from the premises to an authorized disposal or chipping site. The cost orthe City's abating the nuisance shall be billed to thc owner or occupant o[the premises upon which the nuisances existcd." If the diseased Irce(s) is not removed by Monday, October 16, 2006, a request to proceed with abatement will bc brought 10 the City Council for approval on October 30,2006.
