If the test discloses that thc trees or wood are not so discased, the City <br />shall bcar all thc costs and the forester shall remove the trees or wood from the list of discased <br />trecs. If the test eonfirms the original diagnosis that the trees or wood or both as the case may be, <br />are diseased, notice thereof shall be scnt the owner by the forester, and the owner shall removc <br />the diseased trees or wood or both as the case may be, within onc weck aftcr reccipt of the <br />notice. <br />Subd. 14 Spraying or Treatment of Shade Trees. <br />A. Whenever the forester detennines that any shade tree or shadc tree wood within <br /> the City is infectcd with shade tree disease, hc or she may spray or treat all nearby <br /> high value shade trecs by sueh chemical or mech:mical means as will bc cffective <br /> to prcvent as fully as possible the spread of shade trce disease thereto. The <br /> forester may also eause the diseascd shade trecs or wood to be sprayed or treated <br /> hy chemical or mechanical mcans so as likewise to control the possible spread of <br /> shade tree disease to ncighboring, high value shade trees. Such proecdure shall be <br /> carried out in accordance with current technical and expert opinions and plans of <br /> the State Department of Agriculture and under the supervision of thc Department <br /> whenever possible. <br />B. As determined nccessary by the City Forcster, the City may utilize chcmical <br /> means of treatment. If chcmical treatments are deemed necessary, the cost for . <br /> this service shall be borne by the City: The costs of the mechanical means of <br /> treatment shall bc bome hy the owner or occupant of the premiscs, thc shadc trees <br /> upon whieh have been mechanically treatcd by the City. The owner or oceupant <br /> of the premises shall he hilled the costs ofthc mechanical treatment, and in the <br /> event of nonpayment of the bill within thirty (30) days of the date thereof~ the <br /> Council may then assess the amount due, plus interest, in thc manner provided in <br /> Subd. 10. <br />e. The forester shall notify, in the manner provided in Suhd. 9, each owner or <br /> occupant of real cstate within the City of the datc after which shadc trees on his or <br /> her propcrty shall be mechanically treated, which datc shall not be less than five <br /> (5) days from the date of mailing the notice. <br />Subd ] 5. Transportation of Epidcmic Diseased Wood. It is unlawful tor any person to transport <br />within the City any diseased wood that is determined to be hazardous, as described in Subd. 6. <br />Suhd ] 6. Public Tree Care. Thc City has the right to plant, prune, maintain, remove or perfonn <br />any other arboricultural practices as ncccssary on all public property including the street right-of- <br />way to ensure public safety and to preserve or enhance the symmetry and beauty of such pub lie <br />grounds. <br />Suhd 17.
