The applicant shall supply the required number of ADA accessible parking spaces <br />prior to the issuance of the occupancy permit for the University Commons. <br />10. The University Commons project shall be subject to Fire Marshal approval. The <br />applicant shall comply with any conditions set by the Fire Marshal. <br />11. The applicant shall provide updated building footprint, impervious coverage, and total <br />building square footage data prior to any new building proposals at the campus. <br /> <br />Options <br /> <br />1. Approve the proposal as submitted. <br />2. Approve the proposal with conditions. <br />3. Deny the application with reasons for denial. If the City denies the petitioners request, "... it <br />must state in writing the reasons for the denial at the time it denies the request." <br />4. Table for additional information. <br /> <br />The Site Plan Review and Variance are contingent upon each other and have been combined into <br />one action. If a motion to deny is made and the denial is based on the design or layout of the <br />structure, the motion must include specific findings as to why the proposal will have a negative <br />impact and why those impacts cannot be mitigated. <br /> <br />If the motion to deny is made and the motion is related to the height variance, the motion must <br />include specific findings that demonstrate the proposal is not in compliance with any or all ofthe <br />four height variance criteria in 1325.03 Subd 3.C of the Zoning Code. A height variance is not <br />subject to the normal "undue hardship" criteria in section 1355.04 Subd 4. <br /> <br />Deadline for Al!encv Actions <br /> <br />The City of Arden Hills received the completed application for this request on February 15, <br />2007. Pursuant to Minnesota State Statue, the City must act on this request by April 15, 2007 (60 <br />days), unless the city provides the petitioner with written reasons for and additional 60 day <br />review period.
