Royal Oaks - Vacating of a 20 foot wide Pedestrian Walkway Easement at the Old <br />City Hall Site <br /> <br />Mr. Lehnhoff stated Royal Oaks Realty was requesting the vacation of the Pedestrian Walkway <br />Easement. The easement was approximately 20 feet wide by 280 feet long and was located on the <br />former Arden Hills City HalllPublic Works property at 1440-1450 West Highway 96. <br /> <br />Mr. Lehnhoff also stated that he recommends that condition one be removed from the staff <br />recommendation. Since the easement would need to be vacated for anyone that purchased this <br />property, the vacation should not be contingent upon conveying the trail along the western side of the <br />property to the City. He stated the City would require anyone purchasing the property to convey the <br />trail to the Oty. Should Royal Oaks decide to not develop the property, the City would have to <br />address this easement again in the future if the condition is kept. <br /> <br />Conncilmember Holden asked why we would want to vacate this easement without the condition. <br /> <br />Mr. Jerry Filla stated that the City is the fee owner of the property, and the City Could place future <br />easement on the property. <br /> <br />Mayor Aplikowski opened the public hearing at 7:10 p.m. <br /> <br />There were no comments made. <br /> <br />Mayor Aplikowski closed the public hearing at 7:11 p.m. <br /> <br />MOTION: Councihnember Larson moved and Councihnember Holden seconded a motion <br />to approve the Resolution 06-49 to vacate the 20 foot wide pedestrian <br />walkway easement at 1440-1450 West Highway 96. The motion carried <br />unanimously (3-0). <br /> <br />7. NEW BUSINESS <br /> <br />A. Planning Case 06-028; Site Plan Review - Hien Ngo & Nguyet Ky; 3433 Lake <br />Johanna Boulevard <br /> <br />Mr. Lehnhoff stated the Planning Commission reviewed the re-landscaping plan and unanimously <br />voted to table the application at their October 4, 2006 meeting. While the landscaping plan was moving <br />
