The compact Amur maples shall be at least four (4) feet <br />tall upon planting. <br /> <br />g, The Isanti Dogwoods in the shoreline area shall be <br />replaced with Rice Creek Watershed District approved <br />vegetation that does not encroach on the right-of-way or <br />the walking path at full growth. <br /> <br />h. Three (3) or four (4) of the larger trees currently located <br />on the periphery of the Property shall be more centrally <br />located, as approved by the City Planner. <br /> <br />i. The six (6) proposed trees near the north Property line <br />shall be at least ten (10) feet from the drainage pipe. <br /> <br />2. R;qht-of-Wav. No additional trees shall be removed from the <br />public rights-of-way without permission from the City Forrester <br />and City Planner. <br /> <br />3. Reolacement of Veqetat;on. Any vegetation within the <br />Landscaping Plan that are deemed dead or dying by the City <br />Planner or City Forrester shall be replaced within three (3) <br />months or, if not possible due to the end of the growing season, <br />by the beginning of the next planting season, Any trees, shrubs or <br />bushes that need to be replaced shall be done so with the same <br />species, Using a different species shall require approval from the <br />City Planner. <br /> <br />4. Veqetat;on Relocation. Ngo/Ky may relocate the new trees in the <br />landscaping plan to provide additional screening for the dwelling <br />or to ensure the long-term health of the trees subject to City <br />Planner approval. Ngo/Ky shall not reduce the total number of <br />trees in the Landscaping Plan. <br /> <br />5. Secur;tv. NGO/KY shall submit a financial surety in the amount of <br />125% of the estimated cost of the landscaping prior to the <br />beginning of the Landscaping Plan and prior to receiving any <br />building permits, The estimated cost of the landscaping plan is <br />$47,274. The surety shall include the landscaping for the entire <br />Property, including the shoreline landscaping, The financial <br />surety shall be subject to approval by the City's attorney on the <br />following release schedule: <br /> <br />a. 50% of the total security shall be released upon full <br />implementation of the Landscaping Plan that is approved <br /> <br />2 <br /> <br />
