<br />I. Traffic Visibility - Subd. 4.K <br /> <br />Regulation: On all lots, nothing shall be placed or allowed to grow in such a manner as <br />to materially impede vision between a height oftwo and one-half (2-112) and ten (10) feet <br />in the clear vision area. <br /> <br />Proposal: The proposed fence is not near an intersection and would not impede traffic <br />VISIOn. <br /> <br />Additional Information: <br /> <br />The six properties that are adjacent to the Lexington Avenue right-of-way and north of <br />Pleasant Drive have a wider right-of-way than those properties south of Pleasant Drive <br />(Attachment 3B-l). The narrower right-of-way and higher elevation for the properties <br />south of Pleasant Drive permit them to construct fences that are closer to the Lexington <br />Avenue pavement, which provides more effective screening. In fact, most of the <br />residential properties south of Pleasant Drive have fences. The properties north of <br />Pleasant Drive, however, cannot construct fences as close to Lexington Avenue because <br />the right-of-way extends farther from the edge of the road and the fencing is less effective <br />because of the lower elevation from the road. <br /> <br />2. Conditional Use Permit Evaluation <br /> <br />Section 1355.04 Subd 3 ofthe Arden Hills Zoning Code lists the criteria for evaluating a <br />Conditional Use Permit, which is also used to evaluate Site Plan Reviews. The Planning <br />Commission and City Council shall consider the effect ofthe proposed use upon the health, <br />safety, convenience and general welfare ofthe owners and occupants ofthe surrounding <br />land, in particular, and the community as a whole, in general, including but not limited to the <br />following factors: <br />I. Existing and anticipated traffic and parking conditions; <br />2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid <br />waste, and other nuisance characteristics; <br />3. Drainage; <br />4. Population density; <br />5. Visual and land use compatibility with uses and structures on surrounding land; <br />adjoining land values; <br />6. Park dedications where applicable; and the <br />7.
