II of the <br />Arden Hills City Code <br /> <br />Background <br />Recently City staff and City Attorney Jerry Filla reviewed the City's charitable gambling <br />ordinance and noticed that a few changes were needed to bring the ordinance into compliance <br />with State Statutes. The following is an overview of the recommended changes: <br /> <br />1. City staff is recommending that the following language identified in bold be removed <br />from 300.02 Subd 9. of the City's Gambling Code: <br /> <br />Local Gambling Tax. The Conncil may, pursuant to state law, impose a local gambling tax <br />on all organizations licensed to conduct lawful gambling within the City. The tax shall be <br />set by the City Council but shall not exceed three (3%) percent of the organization's gross <br />profit from gambling activities within the City. Proceeds of the tax shall only be used for <br />the purpose of regulating all gambling activities within the City, inclnding but not limited <br />to the reimbursement of the City's administrative, legal, and consulting costs. <br /> <br />City staff is recommending that the following language be adopted in 300.02 Subd 9. of the <br />City's Gambling Code: <br /> <br />Local Gambling Tax. The City may, pursuant to State Law, impose a local gambling tax on all <br />organizations licensed to conduct lawful gambling within the City. The tax shall be set by the <br />City Council, but shall not exceed three percent (3%) of the organization's gross receipts from all <br />lawful gambling, less prizes actually paid out by the organization. Proceeds of the tax shall only <br />be used for the purpose of regulating all gambling activities within the City, including but not <br />limited to, the reimbursement of the City's administrative, legal and consulting costs. <br /> <br />2.
