This
arbitration concerns the still-open contract for the construction of the Arden Hills City Hall.
During the summer of 2003, the City participated in a mediation process with the General
Contractor, Rochon, in order to try and settle the dispute. We had another attempt at mediation
in November 2006. The mediation process has not been successful thus far, so the arbitration
has been scheduled.

DISCUSSION

In May 2006, the City Council authorized staff to retain the services ofMr. Jeffrey W. Coleman
as an attorney for the City Hall arbitration case. At that time, Council authorized $50,000. The
City has paid a total of $34,861.14. We have invoices for services totaling an additional
$34,128.01, for a total of $68,989.15. At this time we have asked Mr. Coleman to prepare an
estimate for the additional services that will be needed between now and the arbitration hearing.
We anticipate needing additional authorization offunds once we have reviewed that estimate.

RECOMMENDA nON

Motion to authorize additional funds for the legal services of Mr. Jeffrey W. Coleman for the
City Hall Arbitration case, at a rate of$250 per hour, in the amount of$30,000.

MW
Ilmetro-inetlardenhillsladminlCity AdministratorIMemoI20071/-29-07 Memo HE City Hall Attnyfees.doc
