<br />I. Any excess dirt shall be removed from the property within two weeks <br />of completing the project. Permanently storing or dumping the dirt <br />on the subject property shall not be permitted without prior approval <br />from the City. <br /> <br />J. Permittee hereby establishes a landscaping easement over, under <br />and across the following portions of parcels 3 ft 4: <br /> <br />Beginning at the Northwest corner of said Lot 2, thence North 89 <br />degrees, 32 minutes 52 second East, assume bearing, along the North <br />line of said Lot, a distance of 8.82 feet; thence South 00 degrees, 00 <br />minutes, 00 seconds West 36.98 feet, thence North 90 degrees, 00 <br />minutes, 00 seconds West 377.28 feet; thence North 00 degree, 00 <br />minutes, 00 seconds East 34.00 feet to the North line of said Lot 1; <br />thence North 89 degrees 32 minutes, 52 seconds East along said North <br />line 370.00 feet to the point of beginning and there terminating. <br /> <br />The landscape easement shall be for the benefit of parcels 1 ft 2 and <br />shall not be extinguished without prior consent of the Arden Hills City <br />Council. The landscape easement is created specifically to facilitate the <br />expansion of parking on parcels 1 ft 2 and to create a replacement <br />landscaping area on parcels 3 ft 4. No impervious coverage or other <br />development shall be placed within the landscape easement. The City <br />shall not be responsible for maintaining the easement. <br /> <br />3.0 Compliance.
