<br />Boulevard (a minor arterial) because of the availability of Fairview Avenue (a local street). <br />Consequently, the only potentially practical location for a garage is at the rear of the lot, with <br />access from Fairview Avenue. <br /> <br />At the rear of the lot there is a 3-4 ft drop from the street/garage elevation at approximately 30 ft <br />from the 10t line, and another 2 ft drop within the next 10-15 ft. This explains why the existing <br />detached garage was placed at its present location. <br /> <br />For the new attached garage, complying with the Zoning Code's demand for a 40 ft building <br />setback on this "second front yard" while still keeping the garage at a reasonable elevation <br />relative to the street would require that the second 20 ft of a 40-ft driveway be constructed on <br />approximately 3-5 ft of fill, and that the entire garage pad be constructed on approximately 6 ft <br />offill; this amounts to approximately 300 cubic yards. Assuming 12 cubic yards per truckload, <br />this would require 25 truckloads of fill to accomplish. <br /> <br />The existing properties to the north have their garages placed on their western extremes, fronting <br />a private alley, which is effectively an extension of Fairview Avenue. The garage immediately <br />north of my property is located 19.5 ft from the rear property line, or approximately 10 ft from <br />the edge of the alley. I am proposing that my new house's attached garage be constructed in line <br />with these existing garages; this requires a variance to reduce the required setback from the west <br />lot line (Fairview Avenue) from 40 ft to 13 ft. <br /> <br />It is interesting and relevant to note that the City's Zoning Code Section 1325.03 ("Exceptions to <br />the Minimum Requirements for all Districts") states: <br /> <br />C. Through Lots. The Administrator may determine that one of the front yards may be <br />deemed a rear yard and shall determine appropriate rear yard setback regulations. <br />Factors to "e considered shall include topography, location of structures on adjacent <br />lots, and iLe tY1"es of streets or thoroughfares abutting the lot. <br /> <br />1 believe this is a reasonabie variance request because the degree of setback requested is in <br />keeping with the pattern set by the existing garages to the north, and substantially exceeds the <br />setback of the existing garage to the south. The 13 ft setback permits constnlction of the new <br />attached garage and driveway without resorting to huge amounts of imported fill, in accord with <br />considerations outlined in the Zoning Code, while not changing the character of the <br />neighborhood. <br /> <br />Request for rebuild of existing detached garage with increased (non-conforming) setback <br />The existing detached garage is located in the extreme southwest comer of the property. Due to <br />its marginal condition, I would like to rebuild it. The City's Zoning Code presently restricts <br />residential properties to a single driveway, although dozens of houses in the vicinity have <br />multiple driveways, including two within 200 ft of my property. In order for a single driveway <br />to serve both the proposed attached garage and the detached garage, it is necessary to re-orient <br />the detached garage to have its vehicle doors facing northward rather than westward. <br />
