<br />The supplementary information submitted by the applicant explains the reasoning for the <br />gravel driveway variance request and proposes findings of fact to support the variance <br />request. <br /> <br />All driveway types (gravel, paved, concrete, pavers) count toward the 35 percent lot coverage <br />limit. With the gravel drive, the lot coverage is 34 percent. Without the gravel driveway, the <br />lot coverage is 31.2 percent. Although gravel driveways are more pervious than a paved or <br />concrete driveway, it is generally not as pervious as landscaped or vegetative areas due to <br />ground compaction. Since the gravel driveway does not cause the lot to exceed the 35 <br />percent lot coverage limit and since the applicant is trying to reduce the potential for future <br />stom1\vater problems, it may be worth considering pervious pavers in place of the gravel <br />driveway. Pervious pavers (or other similar surface) would not require a variance, and it <br />would likely meet the goals of the applicant and the Zoning Code. <br /> <br />5. Flood Plain, Wetlands, and Easements <br /> <br />The proposed redevelopment is outside of any floor plains, wetlands, or easements. <br /> <br />6. Additional Review <br /> <br />This application will require Rice Creek Watershed District approval prior to the issuance of <br />any building pennits. <br /> <br />Variance Evaluation Criteria <br /> <br />The criteria listed below must be used to evaluate each of the variance requests. <br /> <br />A. Variance Review Criteria - Section 1355.04 Subd. 4.C: <br /> <br />Variances from the literal provisions of the Zoning Code may be granted in instances <br />where the strict enforcement would cause undue hardship because of circumstances <br />unique to the individual property under consideration. Variances shall only be granted <br />when it is demonstrated that such actions will be in keeping with the spirit and intent of <br />the Code. "Undue hardship," as used in connection with the granting of a variance, <br />means: <br /> <br />. The property in question cannot be put to a reasonable use under conditions <br />pem1itted by the Zoning Code; <br />. The plight of the landowner is due to circumstances unique to the property <br />not created by the landowner; <br />.
