<br />ARDEN HILLS CITY COUNCIL - AUGUST 27, 2007 <br /> <br />2 <br /> <br />Richard Gonzalez, 3431 Lake Johanna Boulevard, recently submitted a variance application. <br />He expressed his concerns about the process for approving a variance and the lack of opportunity <br />for the resident to present arguments or provide additional information regarding the variance <br />request. He stated that as an applicant he was not allowed to speak to the issue to the Councilor <br />Planning Commission when the vote was being taken. Councilmember Holmes stated she was <br />a member of the Planning Commission and believed the applicant did have an opportunity to <br />speak. Mr. Gonzales stated he could have spoken at the first Planning Commission meeting, but <br />not the second where the decision was made. <br /> <br />City Planner Lehnhoff reviewed the process in place. He stated Mr. Gonzalez did speak at the <br />first meeting but the Plauning Commission did not have any questions regarding the revised <br />request at the August meeting. Mr. Gonzalez did submit a written statement and revised plans, <br />which was provided to the Planning Commission and included in the City Council packet. The <br />variance has been denied. Mr. Gonzalez is invited to submit a revised plan in accordance with <br />the zoning for the area. <br /> <br />Mr. Gonzalez stated he also has concerns about the notice given to the neighbors. He asked ifit <br />is assumed that neighbors are opposed to a plan if they choose not to attend the public hearing. <br />Mayor Harpstead stated that Mr. Gonzalez had requested to deviate from the zoning for the <br />area. <br /> <br />Mr. Gonzales questioned ifhe had to show proof that the neighbors were in favor of the project. <br />Councilmember Holmes stated she did not believe there was an assumption of opposition based <br />on the fact no neighbors attended the public hearing. Councilmember McClung agreed that <br />assumption did not take place in the past, while he was on the Planning Commission, and he does <br />not believe it is now. <br /> <br />City Planner Lehnhoff indicated he will follow-up with Mr. Gonzales regarding this matter. <br /> <br />3. APPROVAL OF MINUTES <br /> <br />A. July 30,2007 City Council Meeting <br /> <br />City Administrator Wolfe requested these minutes be removed from the agenda to give an <br />opportunity for further review. <br /> <br />B. August 13,2007 City Council Meeting <br /> <br />MOTION: Councilmember Grant moved and Councilmember Holden seconded a <br />motion to approve the August 13, 2007 City Council Meeting Minutes as <br />submitted.
