For any filling or excavating on undeveloped land zoned R -I or R-2 where the site is greater than one <br />acre and the proposed till/excavation exceeds four thousand (4,000) cubic yards. <br />f. For any filling or excavating on developed commercial/industrial property where the site is less than two <br />and one-half (2 1/2) acres and the proposed fill/excavation exceeds two thousand five hundred (2,500) <br />cubic yards. <br />g. For any filling or excavating on developed commercial/industrial property where the site is greater than <br />two and one-half (2 1/2) acres and the proposed fill/excavation exceeds five thousand (5,000) cubic yards. <br />h. For any filling or excavating on undeveloped commercial/industrial property where the site is less than <br />two and one-half (2 1/2) acres and the proposed fill/excavation exceeds five thousand (5,000) cubic yards. <br />L For any filling or excavating on undeveloped commercial/industrial property where the site is greater <br />than two and one-half (2 1/2) acres and the proposed fill/excavation exceeds ten thousand (10,000) cubic <br />yards. <br />Applications For Permits, Additional Information: All applications for permits for grading and filing activities <br />or land disturbances within the overlay district resulting in more than one acre of exposed soil shall be <br />accompanied by plans, specifications, and completion schedules in conformance with the "Ramsey County <br />Erosion and Sediment Control Handbook" prepared by the Ramsey Soil and Water Conservation District, <br />1989 as amended. <br />Building Permits, Special Provisions: All building permits involving any excavation, fill or grading shall <br />contain special provisions that specify; <br />1. That the permittee is responsible for the cleanup and any damages resulting from soil eroded from the <br />building site onto public streets and storm sewer system and/or any adjoining private property; and <br />2. That the permittee shall install and maintain either silt fencing along the lot boundaries where runoff is <br />possible to public streets and adjoining private property or maintain a temporary mulch on all exposed soil at a <br />rate specified by the City Engineer. <br />Shoreland Alterations: Alterations of vegetation and topography shall be regulated to prevent erosion into <br />public waters, fix nutrients, preserve shoreland aesthetics, preserve historic values, prevent bank slumping, <br />and protect fish and wildlife habitat. Fill and grading activities within shoreland shall comply with subsections <br />1016.25A2a through A21 and 1016.25B. <br />Vegetation Alterations in Shoreland Areas: <br />1. Exemption: Vegetation alteration necessary for the constriction of structures and roads and parking areas <br />regulated by Sections 1016.14 through 1016.16 of this Chapter are exempt from the vegetation alteration <br />standards that follow. <br />2. Vegetation Alteration Standards: Removal or alteration of vegetation is allowed subject to the following <br />standards: <br />a. Intensive vegetation clearing within the shore and bluff impact zones and on steep slopes is not allowed. <br />Intensive vegetation clearing outside of the impact zones is allowable as a conditional use if an erosion <br />control and sedimentation plan is developed and approved by the Ramsey County Soil and Water <br />Conservation District. <br />b. In shore and bluff impact zones and on steep slopes, limited clearing of trees and shrubs and cutting, <br />pruning, and trimming of trees may be allowed to provide a view to the water from the principal dwelling <br />site and to accommodate the placement of lawns and new vegetation, stairways and landings, picnic areas, <br />access paths, beach and watercraft access areas, and permitted water -oriented accessory structures or <br />facilities, provided that the screening of structures, vehicles, or other facilities as viewed from the water, <br />assuming summer, leaf -on conditions, is not substantially reduced; and <br />c. The above provisions are not applicable to the removal of trees, limbs, or branches that are dead, <br />diseased, or pose safety hazards. <br />3. Connections to Public Waters: Excavations where the intended purpose is connection to a public water, <br />such as boat slips, canals, lagoons, and harbors, shall be controlled by subsections A through D of this section. <br />Permission for excavations may be given only after the commissioner has approved the proposed connection <br />to public waters and other needed approvals have been obtained.
