When a <br />Final POD is approved, there are generally two documents that need to be reviewed and <br />approved by the City Council prior to development: the Final PUD Permit and the Development <br />Agreement. The Final POD Permit outlines the timeline for the phases of the development, lists <br />the approved plans, includes certain conditions that cover each phase of the development, and <br />other conditions that must be completed prior to issuing building permits. <br /> <br />The Development Agreement is a separate document that outlines detailed building, landscaping, <br />parking plans; specific conditions from the POD approval; and other applicable conditions or <br />plans for a specific phase of development. The Agreement will also include any required <br />financial sureties such as a landscaping bond or infrastructure bond. Each of the three phases <br />will require a Development Agreement; however, phase one and two can be combined into one <br />Development Agreement if there is demand for both buildings. It is not uncommon for a <br />development agreement to be reviewed after a POD permit since the complete construction <br />details may not be finalized until the project is closer to actually beginning construction. <br /> <br />Both the Final POD Permit and the Development Agreement must be approved before any <br />building permits can be issued.
