<br />Review Timeline <br /> <br />Mr. Canniff first approached the City Council with this request at their July 9,2007, meeting. <br />The Council asked Mr. Canniff to submit additional information, including a description and a <br />preliminary site plan of the proposed building project. The Council wanted to better understand <br />the potential impacts of the project if the property were transferred to the City of New Brighton. <br /> <br />The applicant submitted a preliminary site plan, building elevations, exterior material <br />information, and a briefletter explaining his intentions for the property at the August 13, 2007, <br />City Council meeting. The Council voted to table this property transfer request to a future <br />meeting pending the submittal of additional infom1ation about the proposed development. Staff <br />was also requested to research the possibility of rezoning the property to a commerciallindustrial <br />use that would be compatible with the applicant's proposal and would allow the property to be <br />retained in Arden Hills. <br /> <br />At the August 27, 2007, meeting, the City Council directed the applicant to continue discussions <br />with the City of New Brighton to detennine the feasibility of the proposed building project under <br />thc New Brighton regulations and the likelihood of New Brighton accepting the propeIty should <br />Arden Hills approve the transfer. The Council also determined that rezoning the Arden Hills <br />property to a commercial/industrial use would not be appropriate. <br /> <br />The applicant and his architect, Aaron Thompson, have had additional discussions with the City <br />of New Brighton, and they have submitted a letter and revised building drawings (Attachment <br />8A-2). Essentially, the New Brighton staff has indicated that a final detennination on the land <br />transfer proposal is needed from Arden Hills before a development plan can be reviewed in New <br />Brighton. Therefore, Mr. Thompson, on behalf of Mr. Canniff is requesting that the Arden Hills <br />City Council take a final action on the property transfer request so that they can determine how <br />they should move forward with New Brighton. <br /> <br />Staff spoke with the New Brighton planning staff, and they indicated that they are reluctant to <br />accept an application that relies on a future action from another city, particularly when it is <br />possible the land transfer request could be denied by Arden Hills. Because detail cd development <br />plans can be expensive to prepare and review, it would be counterproductive for New Brighton <br />to review a plan from Mr. Canniff that assumes a land transfer that has not been approved by <br />Arden Hills. Therefore, the applicant is requesting that the Arden Hills City Council make a <br />final dctennination on the land transfer request. <br /> <br />Transfer Process <br /> <br />In order to transfer a property from one city to another, both cIties must pass resolutions <br />approving the transfer. In this case, Arden Hills must approve a rcsolution detaching the <br />property from the City, and New Brighton must pass a resolution accepting the property. If <br />either City chooses not to approve the resolution, the property transfer cannot occur.
