<br />The proposed amendment clarifies the intent of the code, is in conformance with how the code <br />was applied in the past, and eliminates the incompatibility of the current primary structure <br />setback requirements in the R-2 and R-3 zones. The ordinance could be changed to reduce the <br />permitted encroachments in all districts to a minimum of three feet from any property line, but <br />Staff feels that while the building code permits such a setback, requiring a minimum of six feet is <br />reasonable, except in the R-2 and R-3 districts where a side yard setback of five feet is permitted. <br /> <br /> <br />Options <br /> <br />1. Table: Motion to table Planning Case 07-030 to amend the Permitted Encroachments <br />Ordinance in Section 1325.03 Subd. 2A of the Zoning Code: a specific reason and/or <br />information request should be included with a motion to table. <br /> <br />A change to the Zoning Code requires a public hearing before the Planning Commission and <br />approval from 4/5 of the City Council.
