<br />RFP for Residential Recycling Services <br /> <br />contract. The City shall notifY Contractor in writing or electronically of each act or omission <br />discovered by the City, It shall be the duty of the Contractor to take whatever steps or action <br />may be necessary to remedy the cause of the complaint. <br /> <br />The City may deduct the full amount of any damages from any payment due to the Contractor. <br />The remedy available to the City under this paragraph shall be in addition to all other remedies <br />which the City may have under law or at equity, <br /> <br />Exceptions: For the purposes of this RFP and subsequent contract, the Contractor shall not be <br />deemed to be liable for penalties where its inability to perform recycling collection service is the <br />result of conditions beyond the control of the Contractor, including but not limited to civil <br />disorder, acts of God, inclement weather severe enough that trucks cannot safely take collections, <br />provided however, that the Contractor shall obtain the approval for the delay from the City's <br />Recycling Coordinator or their designee prior to 4:00 p.m. oftre scheduled collection day, <br /> <br />7. INSURANCE AND OTHER LEGAL REQUIREMENTS <br /> <br />7.1 Insurance <br /> <br />Insurance secured by the Contractor shall be issued by insurance companies acceptable to the <br />City and admitted in Minnesota, The insurance specified may be in a policy or policies of <br />insurance, primary or excess, Such insurance shall be in force on the date of execution of the <br />contract and shall remain continuously in force for the duration of the contract. <br /> <br />The Contractor must obtain the following insurance coverage with these minimum levels of <br />coverage: <br /> <br />Worker's Compensation Insurance: <br />Contractor's Public Liability Insurance: <br /> <br />Statutory <br /> <br />$500,000 each/person <br />$1,000,000 each/occurrence <br /> <br />$500,000 each/person <br />$1,000,000 each/occurrence <br /> <br />$1,000,000 aggregate <br /> <br />Property Damage: <br /> <br />Automotive Inmrance: <br /> <br />7.2 Worker's Compensation <br /> <br />The Contractor shall provide evidence of Workers Compensation insurance covering all <br />employees of the Contractor and subcontractors engaged in the performance of the contract, in <br />accordance with tre Minnesota Workers Compensation Law. <br /> <br />7.3 Employee Working Conditions and Respondent's Safety Procedures <br /> <br />The Contractor will ensure adequate working conditions and safety procedures are in place to <br />comply with all applicable federal, state and local laws and regulations. The City reserves the <br />right to inspect on a random basis all trucks, equipment, facilities, working conditions, training <br />manuals, records of claims for Worker's Compensation or safety violations and standard <br />operating procedures documents, <br /> <br />17 <br />
