<br />PLANNING CASE # 08-002 - Variance; ROl!er & Diana Ertel; 1249 Tiller Lane <br /> <br />Ms. Beekman reported that the applicant submitted a variance request to construct <br />a 118 square foot enclosed entryway and stoop to the dwelling at 1249 Tiller Lane <br />that would encroach eight feet into the required front yard setback. She then <br />provided background information and said the findings of fact do not specifically <br />support a recommendation for denial or approval. She stated if the Planning <br />Commission recommends approval, staff recommends the following five <br />conditions: <br /> <br />1. The project shall be completed in accordance with the plans submitted as <br />amended by the conditions of approval. Any significant changes to these <br />plans, as determined by the City Planner, shall require review and approval by <br />the Planning Commission. <br /> <br />2. The applicant shall use best management practices (BMPs) to control erosion <br />at all times during construction, <br /> <br />3, The applicant shall obtain approval or a waiver from the Rice Creek <br />Watershed District prior to the issuance of any building permits, <br /> <br />4, The structure shall conform to all other regulations in the City Code, <br /> <br />5. The addition will match the color and siding of the existing structure, <br /> <br />Chair Sand opened the floor to Commission questions, <br /> <br />Commissioner Holewa inquired if a portion of the house was an addition, Ms, <br />Beekman stated it is an addition, <br /> <br />Commissioner Holewa inquired when the original home was built. Ms. Beekman <br />stated it was built in 1955. <br /> <br />Commissioner Holewa inquired when the addition was built. Ms, Beekman stated <br />it was built in 1993. <br /> <br />Commissioner Holewa inquired about the length of time the homeowners have <br />owned the home, Ms, Beekman stated the homeowners were the applicant for the <br />addition. <br /> <br />Commissioner Larson inquired if the garage is original to the house, Ms. <br />Beekman stated it appears to be, <br /> <br />Commissioner Larson inquired if the setback for the garage has changed. Ms. <br />Beekman stated that information is unavailable. <br />
