<br />and replacement when certain trees are cut. By requiring that a percentage ofremoved trees be <br />replaee, regulating the type and size of the replaced trees, and allowing preserved trees to count <br />towards landscape requirements, the City can effectively promote tree preservation and tree <br />stock diversity with replacement trees. <br /> <br />With this in mind, staff is requesting the City Couneil and Planning Commission discuss the <br />draft ordinances for Design Standards and Tree Preservation. Staff would like feedback on the <br />regulations. In addition, there are a few issues that staff requests further discussion and feedback <br />from the Council and Commission on. These are: <br /> <br />1. Expanding uses versus new construetion. If the owner of an existing development <br />wants to expand, is it appropriate to require the property to meet the same <br />landscaping requirements as a new development? If the property is deficient in <br />landseaping under the new code, does an expansion then require the property to <br />meet the full code regardless of the size of the expansion? Is it possible that these <br />requirements would discourage a property owner from expanding or remodeling? <br /> <br />2. What is an appropriate mitigation rate for tree replacement, taking into account <br />space within a site and need for building pads, parking areas, and construction <br />aceess? If a property needs to remove a significant tree, what is the proper <br />replacement? <br /> <br />3. Should property owners be able to give the City cash in lieu for trees that are <br />required for mitigation, but do not fit on the site? Funds from this fee would be <br />restricted in their use; however, the City could use funds for tree maintenance, <br />buckthorn removal, and tree planting elsewhere in the City, among other things. <br /> <br />Options <br /> <br />It is not necessary to make a motion or come to an agreement on the exact content of a tree <br />preservation or landscape ordinance at this time.
