<br />DEVELOPMENT AGREEMENT <br />CITY OF ARDEN HILLS <br />RICHARD J. CHRISTENSEN <br />PC NO. 08-003 <br /> <br />1.0 Parties. This Agreement is dated the day of , 2008 and is <br />entered into by and between City of Arden Hills, a Minnesota statutory city, <br />(herein "City"); and Richard J. Christensen, his successors and assigns (herein <br />"Developer"). <br /> <br />2.0 Recitals. <br /> <br />A. Developer is the record fee owner of the following described property <br />located in Ramsey County, Minnesota, which will be platted as <br />Christensen Estates: <br /> <br />That part of Tract "B" Registered Land Survey Number 30, which lies <br />Southeasterly of a line run parallel with and distant 75 feet Southeasterly <br />of the following described line, extended Northeasterly to the East line the <br />said Tract "B": <br /> <br />From a point on the South line of section 34, Township 30 North, <br />Range 23 West distant 1160.3 feet East of the Southeast corner <br />thereof, run Northeasterly at an angle of 49 degrees 22 minutes <br />with said South section line for 1588.7 feet; thence deflect to the left <br />at an angle of 22 degrees 00 minutes for 800 feet, to the point of <br />beginning of the line to be described; thence run Southwesterly on <br />the last above described course for 1,100 feet and there <br />terminating. <br /> <br />B. On the 25th day of February, 2008, the Arden Hills City Council reviewed <br />the Development Application for the Final Plat of Christensen Estates; the <br />Arden Hills Staff and Consulting Reports; and approved the Final Plat of <br />Christensen Estates subject to the terms and conditions contained herein. <br /> <br />3.0 Terms and Conditions. In consideration of the City's approval of the Final Plat of <br />Christensen Estates and in compliance with the development regulations of the <br />City of Arden Hills, the parties agree as follows: <br /> <br />A. Compliance with Plans. Developer shall subdivide and configure the <br />property pursuant to the Plan prepared by Lake and Land Surveying, Inc. <br />dated the November 16, 2007 as contained in Arden Hills Planning Case <br />File No. 08-003. <br />
