Warning and disclaimer of liability. <br /> This chapter does not imply that areas outside the <br /> floodplain districts or land uses permitted within such <br /> ~ districts will be free from flooding or flood damages. This <br /> chapter shall not create liability on the part of Arden Hills <br /> or any officer or employee thereof for any flood damages <br /> that result from reliance on this chapter or any administra- <br /> , tive decision lawfully made thereunder. Severability. <br /> If any section, clause, provision or portion of this chapter <br /> is adjudged unconstitutional or invalid by a court of <br /> competent jurisdiction, the remainder of this chapter shall <br /> not be affected thereby. Definitions. <br /> <br /> Unless specifically defined below, words or phrases used <br /> in this chapter shall be interpreted so as to give them the <br /> same meanings as they have in common usage and so as to <br /> give this chapter its most reasonable application: <br /> Accessory use or structure. A use or structure which is <br /> customarily incidental to the principal use or structure of <br /> the lot on which it is maintained or constructed. <br /> Administrator. The duly appointed zoning administrator <br /> for the City of Arden Hills. <br /> Equal degree of encroachment. A method of determining <br /> the location of floodway boundaries so that floodplain lands <br /> on both sides of a stream are capable of conveying a <br /> proportionate share of flood flows. <br /> Supp. No. 3 <br /> 546 <br />
