<br /> <br /> <br /> <br /> § 9.5-28 ARDEN HILLS CODE <br /> <br /> section 9.5-42. These uses are also subject to the provisions <br /> of subsection (C) hereof, which applies to all floodway <br /> special uses: <br /> (1) Extraction of sand, gravel and other materials. <br /> (2) Boat, docks, piers, wharves and water control <br /> structures. <br /> (3) Railroads, streets, bridges, utility transmission lines <br /> and pipelines. <br /> (4) Storage of materials and equipment except as <br /> provided in subsection (C)(3)(a) hereof. <br /> (5) Structures accessory to open space uses. <br /> (6) Placement of fill. • <br /> <br /> (7) Other uses not specifically listed but similar in nature <br /> to uses described in subsections (A) and (B)(1)-(6) of <br /> I this section. <br /> (C) Standards for Floodway Special Uses: <br /> (1) All uses. No structure (temporary or permanent), fill <br /> (including fill for roads and levees), deposit, obstruc- <br /> tion, storage of materials or equipment, or other uses <br /> ' may be allowed as a special use which, acting alone <br /> or in combination with existing or reasonably <br /> anticipated future uses, adversely affects the capacity <br /> of the floodway. <br /> ' (2) Fill. Any fill proposed to be deposited in the floodway <br /> must be shown to have some heneficial purposes and <br /> the amount thereof must not exceed that necessary to <br /> achieve the intended purpose, as demonstrated by a <br /> I plan submitted by the owner showing the uses to <br /> which the filled land will be put and the final <br /> dimensions of the proposed fill or other materials. <br /> Such fill or other materials shall be protected against <br /> erosion by riprap, vegetative cover or bulkheading. ~ <br /> (3) Storage of materials and equipment: <br /> (a) The storage or processing of materials that are, in <br /> times of flooding, flammable, explosive or poten- <br /> Supp. No. 3 <br /> 550 <br />
