A copy of all decisions granting <br /> special use permits shall be forwarded by mail to the <br /> commissioner of the Minnesota Department of Natural <br /> Resources within the ten (10) days of such action. (Ord. No. <br /> 218, § 7(B), 5-26-81) <br /> Sec. 8.5-43. Variances. <br /> The council may authorize, upon appeal in specific cases, <br /> such variance from the terms of this chapter as will not be <br /> contrary to the public interest, where, owing to special <br /> conditions, literal enforcement of the provisions of the <br /> chapter will result in unnecessary hardship. No variance <br /> shall have the effect of allowing in any district uses <br /> prohibited in that district, permit a lower degree of flood <br /> protection than the regulatory flood protection elevation for <br /> the particular area, or permit standards lower than those <br /> required by state law. <br /> (a) Application, review and approval procedure. The <br /> application, review and approval procedure specified <br /> in Section VIIID of the zoning ordinance [Appendix <br /> A] shall be followed for all requests for variances from <br /> the provision of this chapter. <br /> (b) Notification of Commissioner of the Minnesota <br /> Department of Natural Resources. Applieations for <br /> variances shall be submitted by mail to the commis- <br /> sioner of resources at least ten (10) days prior to the <br /> date on which the city council will hear and act on the <br /> variance request. A copy of all decisions granting <br /> variances shall be forwarded by mail to the commis- <br /> sioner of the Minnesota Department of Natural <br /> Resources within ten (10) days of such action.
