<br /> <br /> <br /> <br /> NUISANCES § 16-2 <br /> <br /> September 15, shall be deemed to be in compliance with <br /> r ~ this subsection. <br /> (1.2) If the provisions of the foregoing subsections (1) and (1.1) <br /> are not complied with, the weed inspector shall serve writ- <br /> ten notice upon the owner, lessee or occupant or any per- <br /> son having the care or control of any such lot or land to <br /> comply with the provisions of subsections (1)-(1.3) herein. <br /> If the person upon whom the notice is served fails, ne- <br /> glects or refuses to cut and remove or to cause to be cut and <br /> removed such weeds, grass or other vegetation within five <br /> (5) days after receipt of such notice, or if no person can be <br /> found in the city who either is or claims to be the owner of <br /> such lot or land or who either represents or claims to <br /> represent such owner, the weed inspector shall cause such <br /> weeds, grass and other vegetation on such lot or land to be <br /> cut and removed; and the actual cost of such cutting and <br /> removal, plus eight (8) per cent for inspection and other <br /> additional costs in connection therewith, shall be certified <br /> to the county auditor and shall thereupon become and be <br /> assessed against the lot or land on which such weeds, grass <br /> and other vegetation were located and shall be added to <br /> and become part of the taxes next to be assessed and levied <br /> upon such lot or land and shall bear interest at the same <br /> rate as taxes and shall be collected and enforced by the <br /> same office and in the same manner as taxes. <br /> (1.3) Any person who shall neglect to cut and remove weeds, <br /> grass or other vegetation as directed in subsections (1) <br /> through (12) above or who shall fail, neglect or refuse to <br /> comply with the provisions of subsections (1) through (12) <br /> above or who shall resist or obstruct the weed inspector or <br /> his employees in the cutting and removal of weeds, grass <br /> and other vegetation shall, upon conviction thereof, be <br /> subject to a fine of not less than twenty-five dollars ($25.00) <br /> nor more than five hundred dollars ($500.00); and each day <br /> on which such violation continues shall constitute a sepa- <br /> rate offense. <br /> (2) Accumulation of rubbish, trash, refuse, junk and other <br /> abandoned materials, metals, lumber or other things. <br /> I Supp. No. 18 933 <br /> ~ <br /> I <br />
