Employment of <br /> the spouse of ari elected or appointed off"icer or employee is <br /> not prohibited; however, appointment or assignment of an <br /> employee's spouse in the same department in which the <br /> employee works is prohibited. <br /> (4) Status of employment. Appointment to a position in the <br /> municipal service shall not be construed to be a property <br /> right of the employee. All employees whose positions are <br /> covered by this chapter are appointed by and serve at the <br /> sole discretion of the city council. <br /> ' (5) Promotion from within. It shall be the policy of the city to <br /> fill vacancies by promotion of current employees from within <br /> where practicable. This policy shall not be construed to <br /> preclude the city from external recruitment and/or selec- <br /> tion of applicants outside the municipal service nor as a <br /> waiver of job-relevant qualifications for a position nor as a <br /> guarantee of promotion from within to any and/or all po- <br /> ' sitions for which job openings occur. All job openings shall <br /> be filled based on consideration of job-relevant qualifica- <br /> tions, merit and fitness. Job openings shall be posted in the <br /> city hall for five (5) workdays prior to the filling of such <br /> , vacancies. If a position is filled from within, length of ser- <br /> vice in relevant job classification(s) shall be the deter- <br /> mining factor only when job-relevant qualifications of em- <br /> ployees being considered are equal. <br /> (6) False information. Any applicant or employee giving false' <br /> or misleading information on an application form, cheating <br /> on an examination or falsifying a statement, certificate or <br /> evaluation shall not be considered for employment or shall <br /> be subject to immediate dismissal. Fraud or attempts to <br /> commit fraud which would preclude the city from impar- <br /> tially executing the provisions of this chapter shall be cause <br /> for the city to refuse to appoint an applicant or to dismiss <br /> an employee.
