<br /> <br /> <br /> <br /> ' TREES AND VEGETATION § 27-49 <br /> <br /> clerk-administrator shall issue the permit on form,s provided <br /> for that purpose. If the application is disapproved, the <br /> clerk-administrator shall notify the applicant, in writing, of <br /> the denial and the reasons therefor. (Ord. No. 104, § 2, <br /> 3-I1-68) <br /> Sec. 27-37. Appeal from denial. <br /> The applicant for a permit required by the provisions of <br /> this division may appeal any denial thereof to the city <br /> council by notifying the clerk-administrator, in writing, of <br /> such request within thirty (30) days after receipt of notice of <br /> such denial. The application ahall then be referred to the <br /> board of appeals, which shall consider the application at its <br /> next scheduled meeting and report its recommendation <br /> thereon to the council. If the applicant includes in his <br /> request to the clerk-administrator his desire for a hearing <br /> on the matter, such hearing shall be held before the board <br /> of appeals. After consideration of the recommendation of the <br /> board of appeals, the council shall affirm or reverse the <br /> action of the clerk-administrator. (Ord. No. 104, § 2, <br /> 3-11-68) <br /> Sec. 27-38. Liability for maintenance. <br /> All permits granted under this division shall provide that <br /> the granting of the permit places no obligation upon the city <br /> nor does it impose upon the city any requirement for <br /> maintenance of said trees. Any trees planted on a public <br /> street or other public property are placed thereon entirely at <br /> the risk of the planter and any trees so planted may be <br /> removed, trimmed, maintained, moved, or otherwise changed <br /> at any time by order of the council. In the event that <br /> removal of the treea or maintenance of the treea is <br /> considered necessary by the council and is done at city expense <br /> the cost thereof may be assessed against the property owner <br /> or the abutting property owner.
