Removal of diseased shade trees. <br /> <br /> An owner of real estate in the city who is notified of the <br /> existence on his property of shade trees or wood therefrom, <br /> or both as the case may be, harboring shade tree disease <br /> shall within the time specified in said written notice cut <br /> down each said diseased tree, remove all parta, branches <br /> and brush therefrom, and transport all said parts, branches <br /> and brush from said diseased trees and any such diseased <br /> wood from such premises to authorized disposal or chipping <br /> sites; provided, however, that with reapect to the transporta- <br /> tion of wood from diseased elms, it shall be unlawful for any <br /> , person to tranaport within the city any bark-bearing elm <br /> , wood without having first obtained a permit from the <br /> forester who shall grant such permits only when the <br /> purposes of this article will be served thereby. <br /> The owner shall in addition to cutting down and removing <br /> diseased shade trees or removing diseased wood therefrom, <br /> or both as the case may be, poison the stumps of trees <br /> diseased with oak wilt and shall debark to the ground line <br /> ' the stumps of trees diseased with Dutch elm disease in such <br /> manner as may be approved by the forester. Abatement by city. <br /> Following the inapections or emergency investigations <br /> provided for in section 27-55 hereof, and upon the council's <br /> ' receipt and approval of the report of the foreater of his <br /> I findings as a result of said inspections or investigationa, the <br /> council shall by resolution order the nuisances abated, but <br /> such abatements ahall be postponed until the time apecified <br /> ' for each property owner to abate such nuisancea in notices <br /> ' thereto, as provided in the previous section hereof, has <br /> egpired without the owner having abated such nuisances as <br /> provided in such notice.
