<br /> <br /> <br /> <br /> UTILITIES § 28-19 <br /> <br /> Sec. 28-18. Discontinuance of service for violations. <br /> (a) Subject to the provisions of subsection (b) of this section, <br /> water service may be shut off at any stop box connection whenever: <br /> (1) The owner or occupant of the premises served, or any other <br /> person working on any pipes or equipment thereon con- <br /> nected with the water system, has violated or threatens to <br /> violate any of the provisions of this article. <br /> (2) Any charge for water, service meter or any other financial <br /> obligations imposed hereunder for the premises served by <br /> the connection are unpaid for a period of two (2) consecu- <br /> tive calendar-year quarters. <br /> (3) Fraud or misrepresentation by the owner or occupant of <br /> the premises served in connection with the application for <br /> service. <br /> (b) Water shall not be shut off under subsection (a) hereof until <br /> notice and an opportunity for a hearing shall have first been <br /> given to the cecupant (the "customer") of the premises involved. <br /> The notice shall be personally served in the same manner as <br /> summonses in civil actions and shall state that if payment, proof <br /> of payment or proof of no violation of subsections (axl) or (03) <br /> above have not been made before a date specified in the notice, <br /> but not less than thirty (30) days after the date on which the <br /> notice has been given, the water supply to the premises shall <br /> be shut off. The notice shall clearly inform tHe customer of the <br /> available opportunities to present the city his/her objections to <br /> the bill or the violation claimed in the notice and shall identify <br /> the telephone number, address and officer or employee of the city <br /> who will receive the customer's payment and/or review the cus- <br /> tomer's facts and files and has authority to decide whether pay- <br /> ment has in fact been made or a violation has not occurred, to <br /> correct any errors in billing and to arrange for credit terms. The <br /> notice shall also state that the customer may, before such date, <br /> demand in a writing (which shall contain the customer's return <br /> address) a hearing on the matter. <br /> If, by the date specified in the notice, the city has received the <br /> customer's demand for a hearing, then the city ahall not shut off <br /> the customer's water supply until after the hearing has been <br /> Supp. No.. 16 1645 <br /> I <br />
