<br /> <br /> <br /> <br /> omft ~ <br /> ALCOHOLIC BEVERAGES § 3-47 <br /> (b) All fees shall be paid into the general fund of the city. <br /> Upon rejection of any application for a license the treasurer <br /> shall refund the amount paid with the application. <br /> (c) With reference to on sale liquor license fees, one-fourth <br /> of the license fee as determined and fixed by the council <br /> shall be paid before the issuance of the license; one-fourth <br /> of the fee shall be paid on or before April first of the year <br /> which is the subject of the license, one-fourth of the fee by <br /> July first of such year, and the remaining one-fourth of the <br /> fee shall be paid by October first of the year which ia the <br /> subject of the license. No. 92, § 4(5), 11-15-65) <br /> Sec. 3-47. ftefund of fees. <br /> (a) Except as provided herein, no part of the fee paid for <br /> any license issued under this division shall be refunded, nor <br /> shall any portion of the fee determined to be due for a <br /> license issued under this ordinance be cancelled. Applica- <br /> tions for refund of.liquor license fees may be considered by <br /> the council when the operation of the licenaed business has <br /> ceased for any of the following reasons, to wit: <br /> (1) Destruction of the licenaed premises by fire or damage <br /> by fire to such an extent that the licensee ceases to <br /> carry on the licensed busiziess, or destruction or <br /> damage to said extent by any other catastrophe or <br /> cause; <br /> (2) Discontinuance of the business of the licenaee by <br /> reason of death or illness of the licensee; <br /> (3) A change in the liquor status of the municipality <br /> which makes it unlawful for the licensed business to <br /> continue. <br /> (b) In the event of application for refund for any of the <br /> foregoing reasona, which application shall be made within <br /> thirty (30) days after the happening of any such event, the <br /> council may, at its diacretion, refund a pro rata portion of <br /> such license.
