<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> (f) The requirements of the facility for a waterfront location. <br /> <br /> (g) The availability of,alternative locations not subject to flooding <br /> for the proposed use. <br /> (h) The compatibility of the proposed use with existing development <br /> and development anticipated in the foreseeable future. <br /> <br /> (i) The relationship of the proposed use to the comprehensive plan <br /> and flood plain management program fior the area. <br /> <br /> (j) The safety of access to the property in times of flood for <br /> ordinary and emergency vehicles. <br /> (k) The expected heights, velocity, duration, rate of rise, and <br /> sediment transport of the flood waters expected at the site. <br /> <br /> (1) Such other factors which are relevant to the purposes of this <br /> Ordinance. <br /> 5. Filing with Commissioner of the Minnesota Department of Natural Re- <br /> o <br /> sources. A copy of all decisions granting Special Use Permits shall <br /> be forwarded by mail to the Commissioner of the Minnesota Department <br /> of Natural Resources within the (10) days of such action. <br /> C. Variances <br /> The Council may authorize upon appeal in specific cases such variance <br /> from the terms of this Ordinance as will not be contrary to the public <br /> interest, where, owing to special conditions, literal enforcement of <br /> the provisions of the Ordinance will result in unnecessary hardship. <br /> No variance shall have the effect of allowing in any district uses pro- <br /> hibited in that district, permit a lower degree of flood protection <br /> than the Regulatory Flood Protection Elevation for the particular area, <br /> or permit standards lower than those required by State law. <br /> l. Application, Review and Approval Procedure. ;The application, <br /> review and approval procedure specified in Section VIII-D. <br /> of the Zoning Ordinance shall be followed for all requests <br /> for variances from the provision of this Ordinance. <br /> 2. Notification of Commissioner of the Minnesota Department of Natural <br /> Resources. Applications for variances shall be submitted by mail to <br /> the Commissioner of Resources at least ten (10) days prior to the <br /> date on which the City Council will hear and act on the variance <br /> request. A copy of all decisions granting variances shall be for- <br /> warded by mail to the Commissioner of the Minnesota Qepartment of <br /> Natural Resources within ten (10) days of such action. <br /> <br /> <br /> <br /> 10 <br />
