<br /> <br /> <br /> <br /> STATE OF MINNESOTA <br /> COUNTY OF RAM3EY <br /> VILLAGE OF ARDEN HILLS <br /> ORDINANCE NO. 71 <br /> AN ORDINANCE LICENSING AND <br /> REGULATING THE ESTABLISH- <br /> MENT, MAINTENANCE AND OPER- <br /> ATION OF PUBLIC DRIVING TEES <br /> ' AND PROVIDING PENALTIES FOR <br /> VIOLATION THEREOF. <br /> TI3E VILLAGE COUNCIL OF ARDEN <br /> HILLS DOES HEREBY ORDAIN AS <br /> FOLLOWS : <br /> 3ECTION 1. No peraon, firm or cor- <br /> poration shall establish, maintain or op- <br /> erate a public driving tee, as hereinafter <br /> defined, in the Vi]]age of Arden Hills <br /> without first having obtained a license <br /> therefor as hereinafter provided. <br /> 3ECTION 2. For the purpose of this <br /> Ordinance a public driving tee shall <br /> ~ mean any area within the Village of <br /> Arden Hills arranged or used for driv- <br /> ing of golf balls by the public for s <br /> fee. <br /> SECTION 3. Any peraon desiring s <br /> license to establiah, maintain or operate <br /> a public driving tee shall make applica- <br /> tion in writing to the Village Council <br /> ' by lette! addressed to the Village Clerk <br /> or, if forms for such applications are <br /> supp2ied by the Village Clerk, by com- <br /> pleting such form. The follawing in- <br /> formation is to be set forth in the ap- <br /> plication : <br /> (s) Name and address of the applicant. <br /> (b) The location and legal deacription of <br /> the Froposed driving tee site. <br /> (c) tl etatement as to whether the ap- <br /> plicant owns the property or, if <br /> leased, s copy of said lease, together <br /> - with a statement of the name of the . <br /> property owner, if it is not owned <br /> by the applieant. <br /> (d) The location of the driveways to be <br /> used for ingreas and egresa from <br /> said site. <br /> (e) A atatement as to the Froposed <br /> hours of operatian. <br /> 3FCTION 4: The applieant shall de- <br /> posit with the Village Clerk at the time <br /> of the filing of his application the sum <br /> ' of Fifty Dollars ($50.00), which is here- <br /> ' by set as the license fee to operate a . <br /> publie driving tee, and the Clerk shall <br /> there upon deliver to each applicant <br /> duplicate reeeipts therefor containing a <br /> atatement of the purpose for which such <br /> deposit is made, one of which receipta <br /> shall be attached to and filed with said <br /> . application. SECTION 5. No license for s public <br /> driving tee shall be granted unlesa the <br /> distance from the place of driving to <br /> the nearest bwilding or road in the <br /> direction in which the balla are driven <br /> is 900 feet or more. Such tees shall be <br /> so designed as to permit driving of <br /> golf balls in one general direction, which <br /> direction shall be away from the near- <br /> . est gublic road. SECTION 6. The public driving tee <br /> shall be so lighted as to effectively <br /> illuminate all entrancea and exits, and <br /> lighta used upon the premises shall be <br /> . . placed in such a manner as not to shine upon or unreasonably interfere _ <br /> with surrounding property. <br /> SECTION 7. In no event shall such <br /> public driving tees operate between <br /> the hours af 1 A.M. and S A.M. <br /> SECTION 8. The Council may direct <br /> such investigation of said areas as it <br /> may deem neceasary, and the apBlicant <br /> shall permit any representative of the <br /> Village to inspect and examine the place <br /> deacribed in the application. The Coun- <br /> cil may grant such application if, after <br /> making such investigation as it deem9 <br /> reasonably necessary, it determines that <br /> the granting of said license is conaiatent <br /> with the orderly development of the non- <br /> reaidential areas of the V iilage and will <br /> not unreasonably interfere with the de- <br /> velopment and use af property adjoin- <br /> ing or in the vicinity of the property <br /> which is the aubject of the application. <br /> No License shall be Sranted uniesa the <br /> praperty ia properly zoned for such use <br /> in accordance with the terma of the Zon- <br /> ing Ordinance. <br /> SECTION 9. The licenae herein pro- <br /> vided shall expire on December 31 fol- <br /> lowing the date of isauance, and if is- <br /> sued for a period ahorter than one <br /> ' calendar year the license fee shall be <br /> pro rated on a monthly basis. For the <br /> purpose of pro rating any period in ex- <br /> cess of fifteen days shall conatitute a <br /> month. <br /> SECTION 10. Any person violating the <br /> Droviaions of this ordinance shall be <br /> guilty of a misdemeanor and ahall be <br /> ' punished by a fine not to exeeed One <br /> Hundre8 Dollara ($100.00) or by im- <br /> prisonment not to exceed ninety days. <br /> SECTION il. This ordinance shall be <br /> published in the official yillage news- <br /> paper and shall take effect and be in <br /> force from and after its passage and <br /> publicatian. <br /> PASSED 8Y THE VILLAGE COUN- <br /> CIL OF ARDFIN $ILLS THIS 26 DAY <br /> OF MARCH, 1963. <br /> D.
