<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITYOFARDEN HiLLS <br /> ORDINANCE N0.211 <br /> AN ORDINANCE AMENDING SECTION 6-69 OF THE ARDEN HILLS CODE,ONE OF THE PROVISIONS OF <br /> THE BUILDING CODE CHAPTER RELATING TO <br /> LANDSCAPE PERFORMANCE BONDS, TO ALLOW <br /> FOR LETTERS OF CREDIT AND TO REOUIRE <br /> LANDSCAPE GUARAMTEE BONDS OR LETTERS <br /> OF CREDIT; AMENDING SECTION 6-116 THEREOF <br /> ~ TO CORRECT AN ERRONEOUS CROSS- <br /> REFERENCE; AND AMENDlNG SECTION 14-27 <br /> THEREOF, A PROVISION OF THE MOBILE HOME <br /> CHAPTER WHICH RESTRICTS ADDITIONS TO <br /> MOBILE HOMES, TO PERMIT SITE-BUILT AD- <br /> DITIONS TO MOBILE HOMES <br /> The City Council of the City of Arden Hills hereby <br /> ordains: <br /> Section 1. Amendment to Section 6-69 04 the Arden <br /> Hills Code. Section 6-69 of ihe Arden Hills Code is hereby <br /> amendetl so ihat it is entitled and reads as follows: <br /> "Sec. 6-69. Landscape Performance and Guarantee <br /> Bond or Letter of Credit. <br /> (a) In a case where screening, landscaping or other <br /> exierior improvement to property other ihan the <br /> principal building itself is required by any other ap- <br /> plicable provisions of ihis Code, plansand specifications <br /> as approved for building or other use of the property, or <br /> appropriate council resolution, a performance bond or <br /> letter of credit shall be required as a condition <br /> precedent to the issuance of the building permit. The <br /> amount ot such bond or letter ot credit shall be deter- <br /> mined by the council; provided, however, ihat in no <br /> , event shall the council require a bond or letter of credit <br /> less than one hundred iwenty-five perceni (125 percent) <br /> of the required improvement as estimated by the land- <br /> scape inspector or oTher inspector under whose <br /> iurisdiction the improvement falls, or iheir respective <br /> tleputies. Said bond or letter of credit shall be approved <br /> by the city attorney as To sufficiency, form and <br /> execution. In requiring said bond or IeiTer of credit, the <br /> council shall sTipulate the time wiThin which the per- <br /> formance being bonded or assured is to be carried out. <br /> (b) Where the subiect of the performance bond or <br /> letter of credit has been the installation or placement of <br /> landscaping or screening, said bond or leiter of credit <br /> shall not be released, converted or reduced, until the <br /> inspection and reporting requirements of Section 6- <br /> 176(b) hereof have been fulfilled, and the permittee has <br /> posTed wiih the city (or has converted the existing IeTter <br /> of credit) a guaranTee or maintenance bond or letter of <br /> credit, approved by the city atTorney as to sufficiency, <br /> form and execution, which guarantees To the city ihat <br /> said landscaping or screening shall be maintained and <br /> - be free from disease, defect and death for a period of at <br /> leasione (1) year from the date of the city's approval of <br /> said landscaping,ihe duration of said bond or letter of <br /> credit to be as determined by the city council. In no <br /> event shall the amount of said bond or letter of credit be <br /> greater ihan one hundred percent (100 percent) of the <br /> actual cost of the landscaping or screening im- <br /> provement (i.e., labor and maTerials incorporated <br /> Therein) as determined by the landscape inspector or <br /> ofher inspecTor under whose iurisdiction the im- <br /> provement falls, or their respecTive deputies." <br /> Section 2. AmendmenT to Section 6-116(b) of the Arden <br /> Hills Code. Section 6-116(b) of the Arden Hills Code is <br /> hereby amended to read as follows: <br /> "(b) With respect To any screening, landscaping, <br /> planting or other exterior improvements required in <br /> connection with the consTruction of a principal building <br /> for which a performance bond or leiTer of credit has <br /> been filed with the city pursuant to Section 6-69 (a) <br /> hereof,ihelandscapeinspecTororotherinspector under <br /> whose jurisdiction the improvement falls, or iheir <br /> respective depuTies, shall conduct such inspections and <br /> reinspections as are necessary to ascerTain compliance <br /> with the particular plans and specificationsiherefor, or <br /> requirements of any other applicable ordinances, <br /> resoluTions, or special use permits or other permits of <br /> the rity relating Thereto. Before said performance bond <br /> or letter of credit can be released, a final inspection by <br /> the appropriate inspector, or his deputy, shal I have been <br /> made and a written report containing his final approval <br /> of the improvement, stating the actual cosf ihereof, and <br /> recommendin9 the amount of any replacement <br /> guarantee or maintenance bond or letter of credit shal I <br /> have been submitted to the clerk-adminisirator. <br /> Nothing herein shall be deemed to preclude the ap- <br /> propriate inspector from making interim inspections <br /> and reports nor the council from allowing interim <br /> reductions in the amount of said performance bond or <br /> letter of credit if it deems such reduciion to be ad- <br /> visable." <br /> Section 3. Amendment To Section 14-27 of the Arden <br /> Hills Code. Section 14-27 of the Arden Hills Code is <br /> hereby amended so that it is eniiTled and reads as <br /> follows. <br /> "Sec. 14-27. Additions Allowed. <br /> Construction of any addition to a mobi le home located <br /> within the city to provide exira floor space shall be <br /> allowed provided any such addition either (1) is fur- <br /> nished by a manufacturer and specifically designed for <br /> use with mobi le homes or (2) is built on site and has an ~ <br /> ~ exterior finish which harmonizes with the exterior <br /> finish of the exisTing mobile home, and such addition <br /> complies in all respects with Yhe other provisions of this <br /> chapter, the applicable provisions of the building code <br /> chapter (Chapter 6 hereof), other appl icable ordinances <br /> or chapTers, and applicable permits issued by the <br /> Council wiTh respeci to seTback and similar matters." <br /> SecTion 4. Effective Date. This Ordinance Shall be <br /> effective from and after the date of its passage and <br /> publication. <br /> Passed by the Arden Hills City Council ihis 27ih day of <br /> December, 1979. <br /> Henry J.
