<br />the vacation request is contingent on the approval of the preliminary and final plat for the <br />Traverse Business Center. <br /> <br />The City Engineer has reviewed the vacation proposal and does not have any objections. <br />Temporary easements will be required prior to the execution of the Final Plat and the Resolution <br />that will grant the City access to on-site utilities. New permanent drainage and utility easements <br />will be dedicated to the City once the locations of drainage areas and utilities are finalized prior <br />to the issuance of building permits. <br /> <br />The applicant has submitted an application, narrative describing the project proposal, preliminary <br />and final plat, and surveys of the easements to be vacated (Attachment B). <br /> <br />Recommendation <br /> <br />Staff recommends approving the vacation of the five easements and right-of-way, described in <br />resolution 2008-016 (Attachment A), subject to the following conditions: <br />1. Approval of the preliminary and final plat of the Traverse Business Center as <br />described in Planning Case 08-005. <br />2. The applicant shall grant temporary drainage and utility easements to the City, subject <br />to City Engineer approval, prior to the execution of the Final Plat and Resolution. <br /> <br />Options <br /> <br />1. Approve the proposal as submitted. <br />2. Approve the proposal with conditions. <br />3. Deny the application with reasons for denial. If the City denies the petitioners request, ".. .it <br />must state in writing the reasons for the denial at the time it denies the request." <br />4. Table for additional information. <br /> <br />Deadline for A2encv Actions <br /> <br />The City of Arden Hills received the completed plat application for this request on February 1, <br />2008. Pursuant to Minnesota State Statue 462.358 Subd 3b, the City shall approve or disapprove <br />the plat within 120 days following delivery of an application completed in compliance with the <br />municipal ordinance by the applicant to the municipality, unless an extension of the review <br />period has been agreed to by the applicant. The applicant has submitted a letter extending the <br />City's review deadline to July 30, 2008.
