<br />All of 3rd Ave. NE and 13th St. NE as dedicated in the plat of the northeast <br />corner addition according to the recorded plat thereof, Ramsey County, <br />Minnesota. <br /> <br />The resolution vacating the streets described herein shall not be effective until <br />temporary utility easements are conveyed subject to review and approval by <br />the City Engineer and City Attorney. <br /> <br />7.0 Park Dedication Requirement. CMK shall satisfy the City's park dedication <br />requirement in the following manner: <br /> <br />A. On-Site Improvements. Prior to the issuance of occupancy permits, the <br />applicant shall construct at least $153,400 worth of qualifying on-site <br />recreational and pathway improvements. Qualifying on-site recreational <br />and pathway improvements may include pathways, benches, parks, <br />athletic facilities, and other recreational amenities deemed appropriate <br />by the City Planner and the Public Works Director or their designee. <br />Wetlands, landscaped areas, and other open areas not available for <br />recreational purposes shall not be considered a qualifying improvement. <br />The applicant shall submit on-site improvement plans for City Planner <br />and City Engineer approval prior to the issuance of any permits for the <br />property. CMK shall provide proof of qualifying improvements and <br />associated expenses upon request from the City for evaluation purposes. <br />If construction does not occur by the end of 2008, the minimum value of <br />improvements shall increase by three percent per year starting on <br />January 1, 2009. <br /> <br />B. Gateway Boulevard Improvements/Security. Prior to the issuance of any <br />occupancy permits, the applicant shall construct a six (6) foot wide <br />concrete pathway along the south side of Gateway Boulevard to <br />standards set by the City Engineer and Public Works Director <br />("Pathway"). The Pathway may be immediately adjacent to the <br />backside of the curb. Location of the Pathway shall be reviewed and <br />approved by the City Engineer and Public Works Director prior to the <br />issuance of any building permits. Subject to the limitation set forth in <br />paragraph 7.D below, CMK shall be responsible for site preparation, <br />grading, relocation/replacement of City signs, construction of the <br />Pathway, and site restoration related to the Pathway ("Pathway <br />Improvements"). CMK shall be responsible for repairing any damage to <br />Gateway Boulevard to City standards that occurs during construction of <br />the Pathway. Prior to the approval of the development agreement by <br />the City, CMK shall provide a cost estimate for the Pathway <br />Improvements. CMK shall provide a one year warranty for the Pathway <br />Improvements and a financial surety equal to 125% of the estimated cost <br />of the Pathway Improvements. The form of security shall be subject to <br />the reasonable approval of the City Attorney. The City shall be <br />responsible for general maintenance of the pathway located in City <br />
