■ If a municipality is given written notice of a dispute over a proposed fee in <br />lieu of dedication before the municipality's final decision on an <br />application, a municipality must not condition the approval of any <br />proposed subdivision or development on an agreement to waive the right <br />to challenge the validity of a fee in lieu of dedication. <br />The italicized bullet points are particularly important because they point to the <br />overall theme in State Statutes for setting the park dedication fee. Essentially, the <br />park dedication fee must be reasonable and proportional to the impact of the <br />subdivision on the park system. For example, it would be difficult to require one <br />residential lot to be pay a fee of $20,000 while another lot pays a $5,000 fee when <br />the impact is essentially the same. Most single-family residential lots will have a <br />similar impact on the City's park and recreational system. However, <br />to stay in conformance with City Code and State Statutes, the park dedication fee <br />for Christensen Estates cannot be raised higher than $4,375 for each of the three <br />net new lots. Staff is recommending a total park dedication fee for Christensen <br />Estates subdivision of $13,125. This is the maximum fee, and it can be reduced <br />by the City Council. <br />F.
