4. Shore impact zone <br />• The City does not incorporate the shore impact zone in its shoreland ordinance. <br />• The DNR defines the shore impact zone as an area inland between the OHW and 50 <br />percent of the structure setback (for example, if the structure setback is 50 feet the <br />shore impact zone is the first 25 feet from the lake). The DNR has regulations for the <br />placement of structures, roads, parking, signs, and lighting within the shore impact <br />zone. <br />• Staff recommends adopting the shore impact zone definition and applying the <br />definition where needed. <br />5. Additional definitions <br />• The DNR has a list of 44 definitions in its shoreland management that cities should <br />include for minimum compliance. The City's regulations do not include or fully <br />include 15 of those definitions in its Zoning Code. Definitions in the DNR ordinance <br />that do not pertain to Arden Hills have been omitted. <br />• Staff recommends adopting the applicable DNR definitions into the City's ordinance. <br />6. Controlled access lots <br />• Refers to a lot on the lake that is jointly owned by non -lake (non -riparian) lots for <br />shared access to public waters. <br />• The City does not address controlled access lots in its shoreland management <br />ordinance, though there are a few such lots in the City. <br />• The DNR has model regulations for controlled access lots that regulate usage. <br />• Adopting the DNR's model regulations for controlled access lots may be helpful, but <br />new controlled access lots in Arden Hills are unlikely. A number of cities prohibit <br />new controlled access lots. <br />7. Enhanced variance standards <br />• The City permits variances with the additional requirement that the DNR is notified at <br />least 10 days prior to a hearing or action on the request. <br />• The DNR permits cities to grant variances in line with state statute and requires the <br />10 day notice before hearing and actions. However, the DNR includes additional <br />provisions for variance review. <br />• Staff recommends adopting the enhanced DNR variance review standards. <br />8. PUD and subdivisions <br />• The City has limited guidelines for PUDs and lacks specific guidelines for <br />subdivisions in its shoreland management ordinance. While Chapter 11 of the City <br />Code regulates subdivisions, there appears to be no specific ordinances pertaining <br />strictly to shoreland areas. <br />• The DNR has model regulations for subdivisions and PUDs.
