However, we are not proposing an addition that extends out <br />(on terra firma) toward a neighbors' setback, but rather, the dormer is a visual <br />feature 13 feet in the air above the driveway facing the street. We are <br />asserting that the dormer is not an `unreasonable use', and it is an <br />improvement to the structure, the neighborhood and the City. <br />3. The smaller lot size of the Yauch' lot, accompanied by the subsequently <br />created setbacks, creates limits unique to this property, the street, and the <br />neighborhood, and these limitations were not created by the landowner. <br />4. The dormer is a modest variance, has no apparent negative impacts and is <br />within the spirit of what the variance ordinance is designed to allow after <br />thoughtful review. <br />5. The dormer is clearly a permitted feature in a residential zone. <br />6. This variance enhances the essential character of the house, neighborhood and <br />City. <br />7. This variance request is primarily aesthetic in nature, and not for economic <br />reasons. <br />8.
