<br />ARDEN HILLS CITY COUNCIL - February 9, 2009 <br /> <br />8 <br /> <br />City Attorney Filla stated that the intention was to capture the listing of nuisances <br />in Sections 602.02 and 602.03. He also clarified that if a person did not want <br />someone on their property then an administrative search warrant would be needed. <br /> <br />Community Development Director Lehnhoff stated that health was addressed in <br />Section 602.02 and peace and safety were addressed in Section 602.03. <br /> <br />City Attorney Filla asked if it would be clearer to indicate a reference to Sections <br />602.02 and 602.03 in Section 602.04. <br /> <br />It was the consensus of the Council to add as defined in Sections 602.02 and 602.03 <br />in Section 602.04. <br /> <br />Councilmember McClung clarified that this is an added tool for the City in <br />enforcing codes. He also clarified that Staff was looking into administrative fines <br />and rental licensing. <br /> <br />Councilmember Holden asked how this ordinance would address people making <br />chainsaw sculptures in the yards. <br /> <br />City Attorney Filla stated that in order for the noise to be addressed by the noise <br />ordinance a decibel reading would be required. <br /> <br />Councilmember Grant asked if there was a business being conducted or if this <br />was for personal enjoyment. <br /> <br />Councilmember Holden stated that this was not a business. <br /> <br />Community Development Director Lehnhoff stated that the nuisance ordinance <br />would cover noise but this particular situation would probably not be abated. <br /> <br />Councilmember McClung stated that this would be an example of something that <br />could be covered by an administrative fine. <br /> <br />MOTION: Councilmember Grant moved and Mayor Harpstead seconded a <br />Motion to Approve Ordinance 2009-004 to Amend the Nuisance and <br />Abatement Ordinance as amended in the February 9, 2009, report to <br />the City Council and to Approve Publishing a Summary of Ordinance <br />20009-004. The motion carried unanimously (4-0). <br />
