12. The requested amendment is not expected to have any impacts on population density. <br />13. The park dedication fee is not applicable to this application. <br />14. Approving this amendment does not conflict with the City's Comprehensive Plan or the <br />intent of the Zoning Code <br />Recommendation <br />The Planning Commission reviewed Planning Case 09-019 and unanimously recommends <br />approval (5-0) of the Conditional Use Permit Amendment based on the findings of fact and the <br />submitted plans as amended by the following five conditions: <br />1. The applicant shall continue to abide by the conditions of all previous permits and <br />reviews. <br />2. The applicant will implement a pavement improvement plan, subject to the <br />approval of the City Planner, within six months of the approval of the CUP <br />Amendment. <br />3. The applicant shall implement a landscaping plan substantially similar to the <br />originally approved landscaping plan, subject to the approval of the City Planner, <br />within six months of the approval of the CUP Amendment. <br />4. Buses shall not be permitted to be parked on any surface other than the hard <br />surface of the designated parking area. <br />5. The designated parking area of the facility shall not be expanded in any way. <br />Options <br />1. Approve the proposal as submitted. <br />2. Approve the proposal with conditions. <br />3. Deny the application with reasons for denial. If the City denies the petitioners request, "...it <br />must state in writing the reasons for the denial at the time it denies the request." <br />4. Table for additional information. <br />Deadline for Agency Actions <br />The City of Arden Hills received the completed application for this request on September 8, <br />2009. Pursuant to Minnesota State Statutes, the City must act on this request by November 7, <br />2009 (60 days), unless the city provides the petitioner with written reasons for and additional 60 <br />day review period.
