In cases where the City is required to repeatedly inspect property due to <br />ongoing city code violations, the City has the authority to recover unpaid special <br />charges which could include inspection costs relating to municipal housing code <br />violations. In order to implement this authority, the City would need to adopt an <br />appropriate ordinance or ordinances which would: <br />1. Create a separate City of Arden Hills Maintenance Code; or include in <br />the definition section of the city code, a definition for the term <br />"Housing Maintenance Code" (i.e. housing maintenance Code means <br />Sections 1325-1365 of the Arden Hills City Code); and <br />2. Define the process which would result in a property owner incurring <br />special charges as a result of repeated Housing Maintenance Code <br />Inspections. The process should include a notice of violation, a <br />reasonable compliance period, a statement which indicates that the <br />City will invoice for excessive compliance inspections, and a statement <br />which indicates that unpaid special charges will be assessed against <br />the property. <br />Please review and contact me.
