December 11, 2009 <br />Planning Commission <br />City of Arden Hills, MN <br />1245 West Highway 96 <br />Arden Hills, MN 55112 <br />RE: Compromise Resolution <br />Dear Planning Commission: <br />We a filing a formal appeal of administrative decisions made relating the fence <br />constructed by a Contractor at 1777 Glenview Avenue on their northern property line and <br />on the southern property line of our property at 1774 Gramsie Road. That complaint is <br />included on the following pages. <br />Possible Solutions. A compromise resolution to the fence problems as outlined on <br />the subsequent pages. <br />• This is not what we want but we will agree to consider the resolution. <br />• We ask that the City of Arden Hills intervene on our behalf and enforce the code <br />regarding the proper application of the face boards by removing the individual <br />panels, turn them around so the front of the fence faces our property. <br />• A licensed contractor that we approve and agree is qualified to do the work, will <br />properly screw the frame boards to the footing posts and frame and level each <br />panel according to the proper construction of a fence of this type. This work must <br />be done to our satisfaction. <br />• We want the fence stained to protect it from the elements so it remains new <br />looking on our side of the fence. <br />• What should have happened at the start of the project was the City should have <br />required the homeowners at 1777 Glenview Avenue to produce a site drawing <br />including what the front and back of the fence looked like to insure they were <br />indeed exactly the same materials, look, quality etc. <br />• <br />When it was determined that the fence was not the same on both sides, the City <br />should have required the posts be moved back onto the property at 1777 Glenview <br />Avenue in order to allow enough room for the front of the fence to be constructed <br />from our side so the fence was front facing from our side. <br />• If the Mahoney's refused to set back the fence from the property line, the City <br />should have required the Mahoney's use a different fence design, a staggered <br />
